TurnOut.

1. Agreement and authorized use

By accepting these Terms or accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you enter into an agreement on behalf of a department or other organization, you represent that you have authority to do so. Individual users remain responsible for their own use and compliance with applicable requirements.

TurnOut is intended for authorized fire-department and first-responder personnel. An invitation, valid account, and appropriate department or station permissions may be required. An account or invitation does not establish employment, membership in a public agency, qualifications, or authority to respond to an incident. Your organization determines eligibility, training, assignments, and operational authorization.

2. First-responder responsibilities

Do not rely solely on the Service for emergency notification, staffing, personnel accountability, route selection, incident information, or any decision that could affect life, health, or property. Independently confirm critical information through your organization’s authorized systems and personnel.

Response statuses, qualifications, screenshots, maps, locations, arrival estimates, and messages may be inaccurate, incomplete, delayed, unavailable, or entered incorrectly. Displayed ranks or qualifications are administrative records, not certifications or guarantees of competency. You and your organization are responsible for operational decisions, safe response practices, and compliance with incident-command directions.

3. Driving and compliance with law

You agree to use TurnOut in compliance with all applicable federal, state, and local laws, ordinances, and regulations, including all requirements governing driving, distracted driving, texting, handheld devices, hands-free communications, emergency vehicles, and commercial motor vehicles. This obligation applies during driving of any kind, including operation of a personal vehicle, department vehicle, emergency apparatus, or other vehicle, whether responding to an incident or otherwise.

You must also follow your department’s operating procedures and vehicle-use policies. Do not read, type, select controls, handle your device, dictate messages, or otherwise interact with the Service when doing so is unlawful, unsafe, or distracting. When interaction would be unsafe or prohibited, stop using the Service until you can do so lawfully and safely, such as after safely parking, or have an authorized passenger handle communications when permitted.

Voice entry, hands-free features, automatic updates, an urgent call, or your status as a first responder does not itself make app use safe or lawful. TurnOut grants no right-of-way, exemption from traffic laws, authority to disregard signals or speed limits, or permission to use emergency equipment. You are responsible for determining whether any legally recognized exception applies to your circumstances; the Service does not establish or expand an exception.

4. Accounts and administrator responsibilities

Provide accurate account information, keep credentials confidential, and promptly report suspected unauthorized access to support@responsity.com. Do not share accounts or use another person’s credentials. You are responsible for activity you authorize and for protecting the devices used to access your account.

Administrators must issue invitations only to authorized people, maintain accurate memberships and qualifications, assign privileges appropriately, and promptly remove access when no longer appropriate. Your organization is responsible for required notices, permissions, training, supervision, and lawful use of member and incident information. Removing a station membership does not necessarily delete the underlying account.

5. Your content and acceptable use

You retain rights you hold in information and content you submit, including incident screenshots, messages, department details, and member records. You grant us a limited license to host, process, transmit, reproduce, and display that content as necessary to operate, secure, support, and maintain the Service, consistent with the Privacy Policy. This license does not authorize unrelated advertising use of your content.

Submit only content you are authorized to share. Respect confidentiality, privacy, intellectual-property rights, records rules, and department policies. Limit personal, patient, incident, and location information to what is necessary and lawful for the intended coordination purpose.

6. Privacy and device permissions

Our Privacy Policy explains how information is handled. Location, photo access, microphone access, and speech recognition depend on device permissions and the features you choose to use. Your organization must provide any additional notices and obtain any permissions required for its use of the Service. Revoking permissions can limit features; it does not automatically delete previously submitted information.

7. License and intellectual property

Subject to these Terms and your organization’s authorization, we grant you a limited, nonexclusive, nontransferable right to use the Service for its intended purposes. We and our licensors retain all rights in the Service, software, design, and branding other than rights expressly granted to you. Do not copy, resell, or commercially exploit the Service without written permission, or reverse engineer it except to the extent a restriction is prohibited by law.

Third-party names, images, maps, and software remain the property of their respective owners. Mention or use of a third-party service does not imply endorsement or affiliation.

8. Fees, organization agreements, and third-party services

Any service fees, subscriptions, payment terms, or service commitments must be stated in an applicable order or separate written agreement. These Terms alone do not establish a subscription price or authorize a charge. Your internet provider, mobile carrier, or other third parties may charge for their services.

TurnOut depends on third-party infrastructure and device services, including hosting, authentication, mapping, routing, connectivity, and speech recognition. Those services may have their own terms and privacy practices and may change or become unavailable. App-store license terms also apply where relevant.

9. Availability, updates, and changes

We may maintain, update, modify, or discontinue features of the Service. Unless expressly agreed in writing, we do not promise uninterrupted availability, a specific response time, compatibility with every device, or a particular service level. Network conditions, GPS availability, device settings, operating-system restrictions, maintenance, or third-party outages may affect performance. Beta or testing features may change and may contain errors.

We may update these Terms and will post the revised terms with an updated effective date. For material changes, we will provide additional notice when required by law. Changes operate prospectively; where your consent is required, the change will take effect only after that consent. Otherwise, continuing to use the Service after revised terms take effect constitutes acceptance to the extent permitted by law.

10. Warranty disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES NOT EXPRESSLY PROVIDED IN A SEPARATE WRITTEN AGREEMENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT INCIDENT INFORMATION, RESPONSE STATUSES, LOCATIONS, ESTIMATED ARRIVAL TIMES, OR COMMUNICATIONS WILL BE ACCURATE, COMPLETE, CURRENT, TIMELY, OR AVAILABLE.

Nothing in these Terms excludes a warranty, guarantee, or other right that applicable law does not permit us to exclude.

11. Limitation of liability

This is a single aggregate cap for all related claims, not a separate cap for each user, incident, claim, or legal theory. Fees paid to unrelated third parties, including mobile carriers or device vendors, are not service fees paid to us. A different limit expressly agreed in a signed agreement with your organization controls to the extent that agreement applies.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, ARISING FROM THE SERVICE, INCLUDING DELAYED OR MISSED COMMUNICATIONS, UNAVAILABLE OR INACCURATE LOCATION OR ARRIVAL INFORMATION, OR SERVICE INTERRUPTIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. These limitations apply regardless of whether a claim is based in contract, tort, negligence, statute, or another legal theory.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, gross negligence, death or personal injury, or other matters to the extent applicable law prohibits that exclusion or limitation. The limitations otherwise apply to the maximum extent permitted by law.

12. Suspension and termination

You may stop using the Service at any time. We may restrict or suspend access where reasonably necessary to address a security risk, unlawful use, a material breach, nonpayment under an applicable agreement, or a legal obligation. Your organization may separately change or remove your access. We will provide notice and an opportunity to resolve an issue where reasonable and legally appropriate.

To request account deletion, contact support@responsity.com as described in the Privacy Policy. Applicable confidentiality, ownership, payment, warranty-disclaimer, liability, and other provisions intended by their nature to survive termination will survive.

13. General provisions

These Terms, together with any applicable signed service agreement, govern use of the Service. A signed agreement controls over conflicting terms for the services it covers. Mandatory legal rights and applicable app-store license terms are not displaced. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be limited or severed to the extent necessary, and the remaining provisions will remain effective.

Before initiating a dispute, you may contact us to seek an informal resolution; this does not limit any right to bring a claim or seek urgent relief. Applicable law and any valid governing-law or venue provisions in your signed organization agreement govern disputes. Nothing in these Terms requires arbitration or waives nonwaivable rights.
